Terms of Service
The terms and conditions governing your use of New Breed Haulage services.
These Terms of Service ("Terms") govern your use of the New Breed Haulage website and the dumpster rental and hauling services we provide. By booking a service with us β by phone, online form, or any other means β you agree to be bound by these Terms. Please read them carefully before scheduling a delivery.
1. Services
New Breed Haulage provides roll-off dumpster rental services on Long Island, New York, including Nassau and Suffolk Counties. We offer 5-yard, 10-yard, and 20-yard roll-off containers for residential and commercial use. All services are subject to availability.
By booking a dumpster, you represent that you are at least 18 years old and have the authority to grant us access to the delivery location.
2. Booking & Confirmation
A booking is confirmed when you receive a confirmation from us by phone, text, or email. We will provide a delivery window at the time of confirmation. We reserve the right to reschedule deliveries due to weather, equipment availability, or other circumstances beyond our control. We will notify you as soon as possible in the event of a schedule change.
3. Pricing & Payment
All pricing is quoted on a per-job basis. Your quoted price includes delivery to your address, the stated rental period, pickup, and standard debris disposal unless otherwise specified. Additional charges may apply for:
- Rental periods exceeding the agreed-upon term (additional days charged at the daily rate)
- Overweight containers (weight exceeding the container's rated capacity)
- Prohibited or hazardous materials requiring special handling or disposal
- Failed delivery or pickup due to an inaccessible, blocked, or unsafe site (at driver’s discretion)
- Same-day or emergency scheduling fees, if applicable
Payment is due at or before the time of service unless other arrangements have been made in writing. We accept cash, credit card, check, Venmo, and Zelle.
4. Placement & Delivery Location
You are responsible for designating a safe, accessible, and legal placement location for the container. The container must not be placed blocking public rights-of-way, fire hydrants, or in a manner that violates local ordinances without the appropriate permits. If a street placement permit is required by your municipality, it is your responsibility to obtain it before delivery.
Our driver will use reasonable judgment in placing the container. If the designated location is inaccessible, unsafe, or illegal, we may decline delivery and a trip fee may apply. We are not responsible for damage to driveways, pavement, or landscaping that may occur during normal delivery and pickup operations. Placing a protective board or padding under the container is recommended if surface damage is a concern.
5. Prohibited Materials
The following items are strictly prohibited from being placed in any New Breed Haulage container:
- Hazardous waste of any kind (chemicals, solvents, pesticides, paint, motor oil)
- Asbestos-containing materials
- Batteries (automotive, lithium, or other)
- Tires
- Propane tanks, gas cylinders, or fuel containers
- Refrigerators, air conditioners, or other appliances containing Freon/refrigerants
- Medical or biohazardous waste
- Radioactive materials
- Any liquid waste
If prohibited materials are discovered, you will be responsible for all additional costs associated with proper disposal, removal, or any fines or penalties imposed on New Breed Haulage as a result. We reserve the right to refuse pickup of a container containing prohibited materials.
6. Weight Limits
Each container has a weight limit. Approximate limits are: 5-yard (~1 ton), 10-yard (~2 tons), 20-yard (~4 tons). Overweight containers are subject to additional charges based on excess tonnage at the applicable disposal facility rate. We will notify you if an overweight charge applies before processing payment.
7. Rental Period
Standard rentals include 7 days from the date of delivery. If you need more time, please contact us before the end of your rental period. Extended rental rates apply on a daily basis. If a container is not ready for pickup within a reasonable period after your rental term expires, we reserve the right to schedule pickup at our discretion.
8. Your Responsibilities
You agree to:
- Ensure the site is accessible for both delivery and pickup — a failed delivery or pickup fee may apply if the container or placement area is blocked or inaccessible at driver’s discretion
- Not overfill the container past the fill line (debris must not extend above the top edge)
- Comply with all applicable local, state, and federal laws regarding waste disposal
- Obtain any required permits for street or public-right-of-way placement
- Not allow unauthorized persons to add materials to the container
- Protect the container from theft or tampering during the rental period
9. Limitation of Liability
To the maximum extent permitted by law, New Breed Haulage shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim related to a specific service transaction shall not exceed the amount paid for that transaction.
We are not responsible for any loss, damage, or injury resulting from improper use of the container, prohibited materials, or placement issues that were the customer's responsibility.
10. Indemnification
You agree to indemnify, defend, and hold harmless New Breed Haulage and its employees from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, or any prohibited materials you place in our containers.
11. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes arising from these Terms or our services shall be resolved in the courts of Nassau County or Suffolk County, New York.
12. Changes to These Terms
We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
